Machine Market is a classified advertising platform only.
We are not involved in any sale, purchase, lease, or hire of equipment. All transactions are between users. You are responsible for your own due diligence.
1. Acceptance of Terms
By accessing or using Machine Market (machinemarket.com.au), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the platform. We may update these terms from time to time, and continued use of the platform constitutes acceptance of any changes.
2. Platform Only — Not a Party to Transactions
Machine Market is an online classified advertising platform only. We provide a venue for users to list and discover machinery, equipment, and rural supplies. Machine Market is NOT a party to any transaction between users. We do not own, sell, buy, lease, hire, inspect, certify, value, appraise, warehouse, ship, insure, finance, or handle any equipment listed on the platform. We do not facilitate payments, hold funds in escrow, or act as an agent or broker for any user. Any transaction you enter into is solely between you and the other user. Machine Market has no responsibility or liability for the outcome of any transaction.
3. Your Due Diligence Responsibility
You are solely responsible for verifying the identity, credentials, and claims of any user you transact with. Before purchasing or hiring equipment, you should: inspect the equipment in person; verify the seller's identity and proof of ownership; check the PPSR (Personal Property Securities Register) for encumbrances; confirm serial numbers match documentation; verify the equipment is not stolen (contact local police if in doubt); obtain an independent mechanical inspection for high-value items; and use secure, traceable payment methods. Machine Market makes no representations or guarantees about the accuracy of listings, the condition of equipment, the identity of users, or the legitimacy of any transaction. Listings are user-generated content and have not been verified by Machine Market.
4. User Accounts
You must create an account to list equipment or contact sellers. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current information during registration and keep your account details up to date. You must be at least 18 years of age to use the platform. One person may only operate one account. Creating multiple accounts to circumvent bans or restrictions is prohibited.
5. Listings and Content
Users are solely responsible for the accuracy and legality of their listings and any content they post. Listings must describe genuine equipment that the user owns or is legally authorised to sell or hire. You warrant that any equipment you list is free from undisclosed encumbrances, liens, or legal disputes. Misleading descriptions, stolen goods, counterfeit items, and prohibited items are not permitted. Machine Market reserves the right to remove any listing or content that violates these terms or applicable law, without notice.
6. No Warranty on Listings
Machine Market does not verify, endorse, or guarantee any information in user listings. We do not inspect equipment, verify ownership, confirm hours or condition, or validate asking prices. All listings are provided "as is" by the users who create them. Any reliance you place on listing information is entirely at your own risk.
7. Fees
Machine Market is currently free to use. There are no listing fees, success fees, or commissions. We reserve the right to introduce paid features or services in the future, with reasonable notice to users.
8. Prohibited Conduct
You must not use Machine Market to: post false, misleading, or fraudulent listings; misrepresent the condition, ownership, or legality of equipment; list stolen property or equipment subject to undisclosed finance; harass, threaten, or abuse other users; create fake accounts or impersonate another person or business; use VPN, proxy, or anonymising services to evade bans or misrepresent your location; scrape, crawl, or systematically collect data from the platform; distribute spam or unsolicited commercial messages; attempt to circumvent any security features; manipulate search results, reviews, or marketplace metrics; or use the platform for any purpose that is unlawful under Australian law.
9. Reporting and Safety
Users can report suspicious listings or users via the report button on any listing or seller profile. We encourage all users to report suspected fraud, scams, or prohibited conduct immediately. Machine Market will review reports and may take action including removing listings, suspending accounts, or referring matters to law enforcement. We may also proactively flag accounts or listings that exhibit suspicious patterns. However, we are not obligated to investigate every report or take any specific action.
10. Account Flags and Restrictions
Machine Market may, at its sole discretion, flag, restrict, or suspend accounts that exhibit suspicious behaviour, including but not limited to: use of VPN or proxy services during account creation or listing; multiple failed login attempts; IP addresses associated with known fraud networks; listings with pricing significantly below market value; accounts created with disposable email addresses; unusual patterns of messaging or offer activity; or accounts reported by multiple users. These flags are automated risk signals, not accusations. Flagged accounts may be subject to additional verification requirements.
11. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, Machine Market is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the platform will be available, error-free, or secure. Machine Market is not liable for any loss, damage, injury, or expense arising from: transactions between users, including defective equipment, misrepresentation, non-delivery, or fraud; reliance on information in user listings; any act or omission of any user; or any interruption or error in the platform. You use the platform and conduct transactions entirely at your own risk. Your sole remedy for dissatisfaction with Machine Market is to stop using the platform.
12. Indemnification
You agree to indemnify and hold harmless Machine Market, its owners, operators, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from: your use of the platform; your listings or content; any transaction you enter into with another user; your violation of these terms; or your violation of any applicable law.
13. Intellectual Property
The Machine Market name, logo, and platform design are the property of Machine Market. By posting content on the platform, you grant Machine Market a non-exclusive, royalty-free licence to display that content for the purpose of operating the marketplace. You retain ownership of your content.
14. Termination
We may suspend or terminate your account at any time, without notice, if we reasonably believe you have violated these terms, engaged in fraudulent activity, or pose a risk to other users. You may delete your account at any time by contacting support@machinemarket.com.au. Termination does not release you from any obligations or liabilities incurred while using the platform.
15. Governing Law
These terms are governed by the laws of Australia. Any disputes arising from the use of Machine Market will be subject to the jurisdiction of the courts of Australia.
